Please read these Terms of Service carefully before using Homesta Stay. By accessing or using our platform, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using the Homesta Stay website and booking platform (the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use the Platform.

These Terms apply to all visitors, users, and registered guests of the Platform. We reserve the right to update these Terms at any time; continued use of the Platform after an update constitutes acceptance of the revised Terms.

2. Description of Service

Homesta Stay is an online booking intermediary and brokerage platform for short-term and touristic accommodation rentals. We connect guests looking for accommodation with property owners and managers who list their spaces on our Platform. We are based in Türkiye and currently focus on Turkish cities, with plans to expand to additional destinations.

Homesta Stay acts as an intermediary and facilitator. We are not the owner or operator of the listed properties unless explicitly stated on the listing. The contract for accommodation is formed between the guest and the property owner or manager.

3. User Accounts

To access certain features of the Platform — such as making a booking or saving favourite listings — you may be required to create an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

You must provide accurate, current, and complete information when registering. You must be at least 18 years of age to create an account and make bookings. Homesta Stay reserves the right to suspend or terminate accounts that are found to violate these Terms.

4. Booking and Inquiry Process

When you submit a booking inquiry or reservation request through the Platform, you are requesting availability and entering an inquiry process facilitated by Homesta Stay. A booking is not confirmed until you receive an explicit confirmation from us.

Where online payment functionality is offered, payments may be processed by secure third-party payment service providers. We do not store full card details on our servers. Payment terms, including currency and timing, will be clearly presented at the time of booking.

Booking-specific terms — including pricing, cancellation conditions, and house rules — are described on each listing page and form part of the agreement between the guest and the property host.

5. Our Role as Intermediary

Homesta Stay acts as a broker and intermediary. We facilitate connections between guests and property hosts and provide the booking infrastructure, communication tools, and support services.

We make reasonable efforts to verify the accuracy of listing information; however, we cannot guarantee that all information provided by hosts is complete, accurate, or up to date at the time of booking. Guests are encouraged to read listing details carefully and to contact us with any questions before confirming a reservation.

Any disputes arising from the stay — including property condition, host conduct, or service quality — should be raised with us as the facilitating intermediary, and we will work to mediate in good faith.

6. Host Application

Property owners and managers may apply to list their properties on the Platform by submitting a host application form. By submitting an application, you represent that you have the legal right to list and rent the property, that the information provided is accurate, and that you agree to comply with all applicable laws and regulations.

Listings are subject to review and approval. Homesta Stay reserves the right to decline, suspend, or remove any listing at its discretion. Listing on the Platform does not create an employment, franchise, or agency relationship.

7. Acceptable Use

You agree not to use the Platform for any unlawful purpose or in a way that could harm Homesta Stay, its users, or third parties. Prohibited conduct includes, but is not limited to: providing false or misleading information; impersonating another person; attempting to gain unauthorised access to any part of the Platform; scraping or reproducing content without permission; engaging in fraudulent bookings or payment abuse; and uploading harmful, offensive, or infringing content.

We reserve the right to take appropriate action — including account suspension and legal recourse — against users who violate these rules.

8. Intellectual Property

All content on the Platform — including text, graphics, logos, software, and the Homesta Stay brand identity — is the property of Homesta Stay or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent. By submitting content to the Platform (such as host photos or property descriptions), you grant Homesta Stay a non-exclusive licence to use that content for the purpose of operating and promoting the Platform.

9. Disclaimers and Limitation of Liability

The Platform and its services are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.

Homesta Stay is not liable for: the acts or omissions of property hosts or guests; the condition, suitability, or accuracy of any listed property; any loss or damage arising from your use of, or inability to use, the Platform; or any indirect, incidental, consequential, or punitive damages, to the extent permitted by law.

Our total liability to you for any claim arising out of or relating to your use of the Platform shall not exceed the total fees, if any, paid by you through the Platform in connection with the relevant booking.

10. Cancellation, Refund and Booking Policies

Cancellation, refund, and modification policies vary by listing and may be specified by the property host. The applicable policy for each booking will be clearly presented before you confirm a reservation.

In the event of disputes regarding cancellations or refunds, Homesta Stay will endeavour to mediate between the guest and the host in good faith. Where online payment has been processed, refunds will be issued in accordance with the applicable booking policy and the terms of the payment service provider.

Homesta Stay reserves the right to update its general booking and refund policies as the platform evolves, including upon the introduction of new payment methods. Notice of material changes will be communicated to registered users.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Türkiye, unless applicable consumer protection laws in your country of residence require otherwise.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, legal requirements, or business practices. We will update the "last updated" date at the top of this page and, for material changes, we will take reasonable steps to notify registered users.

Your continued use of the Platform after any change to these Terms constitutes your acceptance of the updated Terms. If you do not agree with an update, please discontinue using the Platform.
